Our mission is to create unforgettable outdoor experiences while maintaining the highest standards of safety, professionalism, and customer service. These Terms & Conditions ("Terms") govern your use of our website and your participation in any guided trip, tour, camping adventure, hiking excursion, outdoor experience, event, or service offered by Roam Freely Outdoors ("Roam Freely Outdoors," "Company," "we," "our," or "us").
By accessing our website, requesting information, making a reservation, submitting payment, or participating in any Roam Freely Outdoors experience, you acknowledge that you have read, understand, and agree to these Terms & Conditions.
Reservations & Booking
Reservations are accepted on a first-come, first-served basis and are considered confirmed only after the required deposit or full payment has been received and a confirmation has been issued by Roam Freely Outdoors.
We reserve the right to decline or cancel any reservation when necessary for operational, safety, or legal reasons.
Pricing & Payments
All prices are listed in U.S. Dollars and are subject to change without notice until a reservation has been confirmed.
Trip pricing includes only those services specifically identified in the published itinerary or booking confirmation. Unless otherwise stated, pricing does not include transportation to or from the departure location, airfare, travel insurance, alcoholic beverages, gratuities, optional activities, personal purchases, or any expenses not expressly listed as included.
Payment schedules and due dates are provided during the booking process. Failure to make payments by the required deadlines may result in cancellation of your reservation.
Changes, Cancellations & Refunds
Adventure travel often involves circumstances beyond anyone's control. Weather conditions, natural events, park closures, road conditions, safety concerns, or other unforeseen circumstances may require modifications to an itinerary.
Roam Freely Outdoors reserves the right to modify, postpone, reroute, or cancel any trip when necessary to protect the safety of our guests, staff, or partners.
Participant cancellations and refunds are subject to the cancellation policy provided at the time of booking.
Should Roam Freely Outdoors cancel a trip, participants may be offered a transfer to another departure, travel credit, or refund in accordance with the applicable cancellation policy.
The Company is not responsible for reimbursement of airfare, hotel accommodations, rental vehicles, lost wages, or other incidental travel expenses.
Outdoor Adventure & Assumption of Risk
Our experiences take place in natural environments where conditions may change rapidly and risks cannot be entirely eliminated.
Participants understand that outdoor recreation may involve inherent risks including, but not limited to:
Uneven terrain
Wildlife encounters
Changing weather conditions
Altitude
Water crossings
Falling rocks or debris
Equipment failure
Remote locations with delayed emergency response
Transportation incidents
Physical exertion
By choosing to participate, you voluntarily accept these inherent risks and acknowledge that outdoor adventure carries responsibilities that cannot be eliminated through planning or preparation.
Participation also requires the execution of Roam Freely Outdoors' Separate Participant Waiver and Release of Liability.
Participant Responsibilities
Every participant plays an important role in creating a safe and enjoyable experience.
Participants agree to:
Follow all instructions provided by guides and staff.
Arrive physically prepared for the selected adventure.
Carry all required personal equipment identified before departure.
Respect fellow travelers, guides, local communities, wildlife, and public lands.
Practice Leave No Trace principles whenever possible.
Comply with all applicable laws and park regulations.
Roam Freely Outdoors reserves the right to remove any participant whose behavior jeopardizes the safety, enjoyment, or well-being of others. Removal from a trip under these circumstances shall not entitle the participant to a refund.
Health & Medical Requirements
Participants are responsible for determining whether a trip is appropriate for their individual fitness level and medical condition.
Guests should disclose any medical conditions, allergies, medications, dietary restrictions, or physical limitations that could reasonably affect their participation or emergency care.
Failure to disclose relevant information may affect our ability to safely accommodate participation.
Travel Insurance
Because adventure travel often involves significant planning and non-refundable expenses, Roam Freely Outdoors strongly recommends that all participants purchase comprehensive travel insurance.
Coverage should include, at a minimum:
Trip cancellation
Trip interruption
Emergency medical treatment
Medical evacuation
Lost or delayed baggage
Personal property
Certain trips may require proof of travel insurance before departure.
Photography & Media
Our guides frequently capture photographs and video during trips to celebrate our adventures and share the Roam Freely Outdoors experience.
Unless you notify us in writing prior to your trip, you grant Roam Freely Outdoors permission to use photographs or video in which you appear for marketing, educational, website, print, and social media purposes without additional compensation.
Website Use & Intellectual Property
All content displayed on this website—including photographs, videos, graphics, logos, itineraries, written content, maps, branding, and design elements—is the exclusive property of Roam Freely Outdoors or its licensors and is protected under applicable copyright, trademark, and intellectual property laws.
No portion of this website may be copied, reproduced, distributed, modified, or used for commercial purposes without prior written permission.
Users agree not to interfere with the operation or security of the website or attempt unauthorized access to Company systems.
Limitation of Liability
To the fullest extent permitted by applicable law, Roam Freely Outdoors, including its owners, employees, guides, contractors, affiliates, and partners, shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from participation in Company activities or use of the Company's website or services.
Any liability of the Company shall be limited to the amount paid by the participant for the applicable trip or service.
Force Majeure
Roam Freely Outdoors shall not be liable for delays, interruptions, modifications, or cancellations caused by circumstances beyond its reasonable control, including but not limited to severe weather, wildfire, flooding, pandemics, government actions, labor disputes, transportation disruptions, natural disasters, or other unforeseen events.
Governing Law
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the State of West Virginia, without regard to conflict of law principles.
Any dispute arising from these Terms or participation in a Company experience shall be resolved exclusively in the appropriate courts of the State of West Virginia.
Updates to These Terms
Roam Freely Outdoors reserves the right to revise these Terms & Conditions at any time. Updated versions will be posted on our website with a revised effective date. Continued use of our website or participation in our services constitutes acceptance of any revisions.
